Required Registration for Managers of Care Home and Day Care Services for Adults

Important Information - applications to be in by 31 May 2009

Legislation came into force on 30 April 2009 that effectively set deadlines for registration with the SSSC for categories of the register that are currently open.

The legislation specifies "required registration" dates for each category of the register after which employers will be committing an offence if, without reasonable excuse, they employ a worker in a post subject to registration who is not registered with the SSSC or another relevant regulatory body e.g. the Nursing and Midwifery Council.

The SSSC will contact employers to advise when applications for registration must be submitted to guarantee registration by the required date. Existing Managers of Adult Care Home and Adult Day Care Services, for example, had to have submitted their application for registration to the SSSC by 31st May 2009 to ensure that their application is processed before the start of the required registration of these workers in November 2009. If any Managers have not done so, they should do so without delay, although there is no guarantee it will be processed on time.  New Managers have 6 months from the date of commencing employment to have completed their registration with the SSSC.

What are the required registration dates for existing workers?

Care Home Services for Adults Managers 30th Nov 2009
Supervisors 30th March 2012
Practitioner 29th March 2013
Support Workers 30th Sept 2015
Day Care Services for Adults Managers 30th Nov 2009
Residential Child Care All workers 30th Sept 2009
Day Care of Children Services Managers 30th Nov 2010
Practitioners 30th Sept 2011
Support Workers 30th June 2014

Required registration dates for workers in parts of the register which are not yet open (eg Housing Support) will be set by the Scottish Government in due course.

What will the legislation mean for new recruits?

The current situation is that only new recruits to posts in the following categories must achieve registration within six months of taking up post:
• Managers of care home services for adults
• Managers of adult day care services

• Residential child care workers

The Scottish Government will revert to the sector to discuss registration of new workers to all other groups in the near future.
